Auction Terms & Conditions

These terms govern bidding in the weekly online auctions on this website. By registering to bid and by placing a bid, you agree to them. Please read them carefully — a bid is a binding offer to buy.

1. A bid is a binding offer

Every bid you place is a binding, irrevocable offer to purchase the lot at that amount, in Canadian dollars. Bids cannot be retracted. When bidding closes, the highest eligible bid at or above any reserve wins, and a contract of sale is formed at that moment (the fall of the hammer).

2. Registration & eligibility

To bid you must create an account, confirm your email address, provide a shipping address, accept these terms, and keep a valid payment card on file. The studio may decline or suspend any account at its discretion. You must be of legal age to enter a binding contract in your province or territory.

3. Reserves, estimates & increments

A lot may carry a confidential reserve — the minimum price the artist will accept. Where a reserve applies, the lot is marked accordingly; if bidding does not reach the reserve, the lot goes unsold. Estimates are opinions, not guarantees of price. Bidding advances in set increments shown on each lot.

4. Automatic (proxy) bidding

You may enter a maximum amount and the system will bid on your behalf, up to that maximum, only as much as needed to keep you in the lead. Your maximum is never shown to anyone. If two bidders enter the same maximum, the earlier one leads.

5. Extended (soft) close

To keep bidding fair, a bid placed in the final moments of a lot extends that lot's closing time by a short, published interval. A lot closes only once a full interval passes with no further bidding.

6. Payment & automatic charge

You authorise the studio to charge the card you keep on file for the full amount owing when you win a lot — the hammer price plus applicable taxes and shipping — without further action from you. This authorisation is a condition of bidding and applies to each lot you win. If that charge does not succeed, you will receive a secure payment link and have 48 hours to complete payment. Title passes only when payment is received in full.

7. Taxes, shipping & currency

All prices are in Canadian dollars. GST, HST or PST is added according to the province or territory of your shipping address, at the applicable rate. Works are shipped tracked and insured at the published rates. Risk passes on delivery; please inspect your piece on arrival and report any transit damage within 7 days with photographs.

8. Non-payment

If a winning bidder does not pay within the cure period, the studio may re-offer the lot to the next eligible bidder, relist it in a future auction, and decline future bids from the account. Unpaid bids may be reported and pursued as the binding offers they are.

9. The studio's discretion

The studio may, before a lot closes, withdraw a lot, correct an error, refuse or void a bid, and re-open bidding where a bid has been voided. Any such action is recorded and shown in the lot's public activity feed.

10. Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, and you agree to the exclusive jurisdiction of the courts of Alberta. Nothing in these terms limits any right you have under applicable consumer-protection law.

11. Changes to these terms

These terms are versioned. If they change materially, registered bidders are asked to accept the new version before their next bid. This is version 1, effective 9 July 2026.
